Two days ago, a three-judge Ninth Circuit panel heard oral arguments in a case that could reshape how every AI agent interacts with the web. The case is Amazon.com Services LLC v. Perplexity AI, Inc., the appeal is numbered 26-1444, and the panel was not kind to Perplexity.

No ruling yet. But the oral argument gave builders a clear read on how courts are currently thinking about this — and it should change how you design agents that access third-party services.

3. Prefer OAuth and explicit API grants

When a service offers OAuth or an explicit API, use it. This is the clearest form of platform authorization — the platform gave you a key. OAuth scope also limits what your agent can access, which reduces risk even if ToS compliance is ambiguous.

4. Separate public-access flows from authenticated flows

Design your agents so that operations requiring authenticated third-party access are clearly separated, clearly disclosed to users, and ideally governed by ToS-compliant integrations. Don’t silently blend public and authenticated access.

The Bigger Picture
