Two days ago, a three-judge Ninth Circuit panel heard oral arguments in a case that could reshape how every AI agent interacts with the web. The case is Amazon.com Services LLC v. Perplexity AI, Inc., the appeal is numbered 26-1444, and the panel was not kind to Perplexity.
No ruling yet. But the oral argument gave builders a clear read on how courts are currently thinking about this — and it should change how you design agents that access third-party services.
The Setup
Perplexity’s Comet browser can log into a user’s Amazon account using credentials the user provides, browse products, and complete purchases on the user’s behalf. The user explicitly directs this. The user’s credentials are used. The user’s account is accessed.
In November 2025, Amazon sued Perplexity in the Northern District of California under the Computer Fraud and Abuse Act (CFAA) — a 1986 law originally written to prosecute hackers — and California’s analogous state statute, the Comprehensive Computer Data Access and Fraud Act (CDAFA), Penal Code §502.
On March 9, 2026, U.S. District Judge Maxine Chesney issued a preliminary injunction blocking Comet from accessing Amazon’s logged-in pages: account history, checkout, order management, and ordered Perplexity to destroy any Amazon account data it had already collected (Cooley client alert; Search Engine Journal). The Legal Distinction That Should Alarm You
The district court’s ruling rests on a single, counterintuitive proposition:
A user’s authorization to an AI agent is not the same as the platform’s authorization.
Judge Chesney’s order states that Amazon presented “strong evidence” that Comet “accesses with the Amazon user’s permission but without authorization by Amazon, the user’s password-protected account,” and that this information is then transmitted to Perplexity’s servers (quoted in Search Engine Journal; consistent with reporting in CyberScoop). The order treats the CFAA’s “unauthorized access” element as satisfied by the platform’s own terms, not the user’s consent.
Amazon’s terms of service require AI agents to identify themselves (for example, via a user-agent string) and limit their access to the public portions of the site; the court found Comet violated those terms by accessing Amazon in a logged-in state without identifying itself as an AI agent (Cooley). Because of that, Comet’s access was found unauthorized, regardless of what the user wanted.
Perplexity’s counter-argument: Comet is the user’s agent in the legal-mechanical sense. When a user instructs Comet to log into their account and buy something, that’s the user accessing their own account through software — no different from accessing Amazon through Safari or Chrome — the analogy Perplexity has argued throughout the case, including on appeal (everything-pr.com). If Amazon Wins
The implications cascade:
Any website can block AI agents by ToS. If a platform’s ToS says “no automated access” and your agent accesses logged-in pages, you’re potentially liable under the CFAA — a federal law. This isn’t just civil exposure; CFAA violations can carry criminal penalties, from misdemeanor fines up to felony prison terms depending on the conduct.
User consent is necessary but not sufficient. You’ll need both user authorization AND platform authorization for authenticated access. For consumer products, getting explicit platform authorization at scale is often impossible without a formal API agreement.
The agent-as-browser analogy fails legally. Builders have long assumed that if a user tells an agent to do something the user could do themselves, the agent is just a tool. The district court rejected that framing. The Ninth Circuit’s skepticism suggests they may too.

The key risk variable is whether your agent is accessing authenticated, logged-in pages of a service that hasn’t explicitly authorized automated access.
What to Do While the Ruling Is Pending
The Ninth Circuit could take weeks to months to issue an opinion. Here’s what to build and audit now:
1. Identify your agent in every request
Your agent should declare itself in user-agent strings, API headers, or wherever the platform provides a signal. Don’t disguise agent traffic as human browser traffic. The identity-spoofing allegation in Comet’s case made Amazon’s argument significantly stronger.

This doesn’t protect you legally, but it removes the misrepresentation angle.
2. Audit every third-party service your agent accesses
For each service:
- Does the ToS allow automated access?
- Does it have an explicit API or automation program?
- Are you accessing public pages or authenticated areas?
If your agent touches authenticated areas of a service that prohibits automation in its ToS, you have CFAA exposure right now — not just after the ruling.
3. Prefer OAuth and explicit API grants
When a service offers OAuth or an explicit API, use it. This is the clearest form of platform authorization — the platform gave you a key. OAuth scope also limits what your agent can access, which reduces risk even if ToS compliance is ambiguous.
4. Separate public-access flows from authenticated flows
Design your agents so that operations requiring authenticated third-party access are clearly separated, clearly disclosed to users, and ideally governed by ToS-compliant integrations. Don’t silently blend public and authenticated access.
5. Add a legal review gate for agentic commerce features
If you’re building a feature where your agent completes transactions or accesses account data on a third-party platform — put it through legal review before shipping. The CFAA is a federal statute. “We didn’t know” is not a defense.
The Watch List
- Ruling timeline: No fixed deadline — Ninth Circuit turnaround from argument to opinion varies widely by case. Watch for an opinion from the same three-judge panel.
- ACLU amicus: The ACLU filed in support of Perplexity, arguing that a ruling for Amazon sets dangerous precedent for internet freedom. This signals the case has implications well beyond AI.
- News/Media Alliance amicus: Filed April 29 in support of Amazon, arguing that if the CFAA doesn’t reach bots that misrepresent their identity to circumvent technical access controls, publishers’ paywall and subscription-based revenue models are undermined. Major publishers see this as a vehicle to stop AI agents from scraping their content even through authenticated accounts.

The Bigger Picture
Anthropic’s Fable 5 and Mythos 5 suspension, a day before this piece went up, was a supply-side shock — the government cut off a model. Amazon v. Perplexity is a demand-side shock — the government (via courts) could cut off what agents are allowed to do.
The underlying tension: AI agents are being deployed in exactly the contexts where they’re most useful — taking actions on behalf of users across the services users already use. That’s also exactly where platforms have the most to lose, and where a 40-year-old hacking statute might be twisted into an anti-agent weapon.
The Ninth Circuit’s answer to “does a user’s authorization extend to their AI agent?” will set the legal floor for agentic AI in the United States. Every builder deploying agents that touch third-party authenticated services should be watching.
