On May 6, 2026, Canada’s Office of the Privacy Commissioner — joined by provincial counterparts in Quebec, British Columbia, and Alberta — released findings from a joint investigation into OpenAI’s ChatGPT. The ruling: OpenAI violated Canadian privacy law. Multiple violations. Multiple provinces. A federal commissioner and three provincial ones in agreement.
The coverage mostly ran as an OpenAI story. It isn’t. It is a builder story, and it has been sitting in the regulatory record for three weeks without the attention it deserves.
What the Ruling Actually Found
The commissioners identified violations across six dimensions: consent, transparency, accuracy, retention, access rights, and accountability.
The consent finding is the one that ripples. Canada’s regulators held that scraping personal information from the public internet does not constitute collection of “publicly available” information under PIPEDA or provincial law. The implication: internet accessibility does not equal permission. Data posted publicly — forum comments, social media posts, health discussions, political commentary — was not available for training without consent, regardless of whether it was technically reachable.
OpenAI’s defense was essentially that users and the public have come to understand that AI models train on internet data. The commissioners rejected this. Regulatory acceptance of a novel practice cannot be inferred from public awareness that the practice exists.

5. Retention policies must exist before launch. OpenAI was cited for deploying without formal data retention and deletion frameworks. If you are building something that processes personal information, the governance infrastructure — policies, schedules, accountability structures — is a launch prerequisite, not a later-stage task.
6. Pre-deployment accuracy assessment is mandatory. You cannot launch a product, wait for user complaints about hallucinations or inaccurate outputs, and then address them. Canadian regulators expect organizations to proactively evaluate and communicate accuracy limitations. What is changing is the documentation burden and the questions your clients will ask.
